The legal definition of this
sex crime is an adult—18 years of age or older---committing the willful and
lewd commission of any lewd or lascivious act (besides sexual assault
or rape) upon the body of a child under 16 years old with intent of arousing,
appealing to, or gratifying the lust of the child or the individual. The
main difference between the
statutory rape and lewdness with a child under 16 has to do with the extent of the physical
touching. If the touching of the child involved physical penetration,
then it is considered statutory rape.
If the minor is under 14 years old, lewdness with a child under 16 is a
category A felony, which is punishable by a life imprisonment sentence
with the possibility of parole after 10 years and a fine of up to $10,000.
If the minor is 14 or 15 years old, then lewdness with a minor is a category
B felony, resulting in a maximum prison sentence of 10 years and a fine
of up to $10,000.
