What Is Considered Indecent Exposure in NV?
Under state law, it is illegal for a person to engage in “any open and indecent or obscene exposure of his or/her person, or of another person.” This generally refers to the exposure of a person’s penis, vagina, breasts, or buttocks. Even seemingly innocent acts such as a teen “mooning” his or her friends for laughs by flashing their bare bottoms may be considered an act of indecent exposure. It is important to note, however, that it is not considered indecent for a mother to breastfeed her child in public.
Indecent or obscene exposure is a gross misdemeanor in Nevada, carrying:
- Up to 1 year in jail
- Up to $2,000 in fines
- Possible sex offender registration
As a type of sex crime, defendants who are convicted of indecent exposure may be ordered to register as a sex offender – a label which can permanently tarnish a person’s reputation and greatly hinder their future opportunities for employment and housing. While registration is a possibility in any indecent exposure case, it is particularly likely in instances where a defendant is accused of exposing themselves to a child.
