Penalties for Drug Trafficking
The penalties you will face will depend upon the type of drug caught in your possession. Drugs are categorized by schedules. You can be charged with drug trafficking if you were caught in possession of a Schedule I or Schedule II drug.
Examples of the schedule of drugs:
- Schedule I drugs - You must possess four grams or more to be charged with drug trafficking or 100 pounds of marijuana or more. This schedule includes Heroin, Cocaine, Methamphetamine, Marijuana, Ecstasy, LSD and GHB.
- Schedule II drugs - You must possess 28 grams or more to be charged with drug trafficking. This schedule includes PCP, doctor-prescribed Cocaine or Methamphetamine, Oxycodone, Morphine, Opium, Demerol, and Adderall.
Drug trafficking charges are prosecuted fiercely in Nevada. If you are convicted of possessing a Schedule I drug between 4 and 14 grams, you will be charged with a felony and will face up to 6 years in prison and a fine up to $50,000. If you are convicted of possessing a Schedule II drug weighing at least 28 grams but less than 200 grams, you will be charged with a felony and will face up to 5 years in prison and a fine up to $50,000. The higher the quantity of drug, the harsher the penalties.
