What is the Serious Offender Program?

Felony DUI convictions often sentence people to jail or prison time without probate, which means the sentence must be fulfilled in its entirety. This is clearly not an ideal situation and can completely ruin your livelihood if you are forced to spend 12+ months behind bars. In order to avoid prison time without probation, you may request eligibility to use the Serious Offender Program (SOP) instead. The SOP allows people to avoid jail time by following a physician’s or specialist’s treatment program over the course of three to five years.

An SOP treatment regimen may include:

  • House arrest
  • Extensive drug and alcohol abuse courses
  • Institutionalization
  • Installation of ignition interlock device (IID)

If the course is completed, the felony conviction may be lessened to a misdemeanor 2nd DUI offense, even if it is the 3rd DUI conviction on the record. Not everyone will be eligible to use the Serious Offender Program. Ask your criminal defense lawyer if this an option for you.
